Comair, Boeing settle dispute

Comair and Boeing have reached an out-of-court settlement in a lawsuit in which the airline sought $83 million (R1,4bn) in damages over the purchase of eight B737-8 MAX aircraft.

In February 2023, Comair sued Boeing, claiming the company had concealed and misrepresented key information about how the 737 MAX compared to older 737 models. Comair also claimed Boeing failed to disclose that pilots would need extensive extra training and that the aircraft was equipped with the Maneuvering Characteristics Augmentation System (MCAS).

Boeing responded with a motion to dismiss, arguing that the “representations” it had made before the agreement were too general for it to constitute concealment.

On August 1, the US District Court for the Western District of Washington confirmed in a docket entry that the two parties had reached a settlement. According to ch-aviation, the terms remain confidential but settlement papers must be filed by September 15.
