SAX appeals business rescue order

SA Express has instructed its attorneys to file an appeal against a court judgement to place it under business rescue.

The Johannesburg High Court ruled in favour of business rescue after an urgent application was filed by Ziegler ZA, earlier this month.

The airline reviewed the content of the judgement and concluded that “the court went over and above what it was required and granted orders not sought by the applicant”.

 “The court has also not made any order on whether the matter was urgent or not, in circumstances when the urgency was specifically opposed. SAX has instructed its attorneys to apply for leave to appeal, which leave will be filed as soon as it is considered and settled by senior counsel,” according to a statement issued by SAX yesterday (February 6).
